Biographie

Harith Al-Dabbagh est est professeur titulaire à la Faculté de droit de l’Université de Montréal. Il est diplômé de l’Université de Mossoul (LL.B., LL.M.), de l’Université de Lyon II (DUEJ), de l’Université Aix-Marseille III (DEA Droit comparé, Doctorat en droit) et de l’Université de Montréal (Post-doctorat). Il fut auparavant avocat, professeur-assistant à la Faculté de droit de Mossoul (Irak) et enseignant-chercheur à l’Université de Saint-Étienne (France). Pendant plus de vingt-cinq ans, il a enseigné divers cours en droit comparé, en droit civil et en droit international privé.

Ses travaux les plus récents se sont orientés vers l’étude des phénomènes liés au pluralisme juridique, à l’internormativité et à la circulation des modèles juridiques. Professeur Al-Dabbagh est l’auteur de trois monographies et d’une cinquantaine d’articles publiés, en langues française, anglaise et arabe, portant sur les interactions entre droit et religion ainsi que les enjeux liés aux minorités, à immigration et à l’intégration. Il a participé à de nombreux événements internationaux et a également agi à titre de professeur invité dans plusieurs institutions en France, en Allemagne, en Italie, en Suisse, au Sénégal, au Liban, en Égypte, au Maroc et aux Émirats arabes unis. Il a été élu membre associé de l’Académie internationale de droit comparé en septembre 2019. En 2024, il a reçu le Prix Louise-Dandurand du Fonds de recherche du Québec pour son texte intitulé « La réception au Québec des gestations pour autrui délocalisées : La filiation post-tourisme procréatif en mal d’institution », paru à la Revue Canadienne de droit familial en octobre 2022.

English biography

Harith Al-Dabbagh is a full professor at the Faculty of Law of the University of Montreal, where he also serves as Director of the LL.M. program in Private comparative law. He holds degrees from the University of Mosul (LL.B., LL.M.), the University of Lyon II (DUEJ), Aix-Marseille University (Master, PhD in Law) and the University of Montreal (Postdoctoral fellowship). He was previously a lawyer, assistant lecturer at the Faculty of Law of Mosul in Iraq and Lecturer-researcher at the University of Saint-Étienne in France. For over twenty-five years, he has been teaching various courses in Civil law, Comparative law and Private international law. He was elected as Associate Member of the International Academy of Comparative Law on September 2019.

His latest research has been focused on the study of the problems arising from legal pluralism, internormativity and circulation of legal models. Professor Al-Dabbagh is the author of three monographs and approximately fifty published articles, in French, English and Arabic, on the interplay between law and religion, as well as issues related to minorities, immigration and integration. He took part in many international conferences and acted as a visiting professor at several academic institutions in France, Germany, Italy, Switzerland, Senegal, Morocco, Lebanon, Egypt, Iraq and the United Arab Emirates. In December 2024, he has awarded the Louise-Dandurand Prize by the Fonds de recherche du Québec for his text on the “Reception in Quebec of cross-border surrogacy: Post-reproductive tourism filiation in need of an institution”, published in the Canadian Journal of Family Law in October 2022.

د. حارث الدباغ

استاذ القانون المقارن والقانون الدولي الخاص بكلية الحقوق , جامعة مونتريال – كندا. بعدما اكمل دراسة البكالوريوس والماجستير في القانون في جامعة الموصل التحق بالدراسات العليا في فرنسا. حصل على دبلوم الدراسات القانونية الفرنسية من جامعة ليون، ثم دبلوم الدراسات المعمقة في القانون الخاص وشهادة في القانون المقارن و الدكتوراه من كلية الحقوق بجامعة اكس-مرسيليا. عمل سابقا كتدريسي في جامعة الموصل ثم جامعة سانت-تيان في فرنسا حيث درّس فيهما العديد من مواد القانون المدني والمقارن. شارك كمتكلم واستاذ زائر في العديد من المؤتمرات والنشاطات العلمية في ايطاليا، المانيا، السنغال، مصر، لبنان، تونس والمغرب. تتمحور اعماله الحالية في المواضيع المتعلقة بالتعددية القانونية والتفاعل ما بين القواعد القانونية الدينية والوضعية والمركز القانوني للأقليات المسلمة في الغرب. له ثلاثة كتب منشورة واكثر من خمسين بحثا رصينا باللغات الفرنسية والعربية والانكليزية حول الانظمة المدنية وعصرنة القوانين في الشرق الاوسط
