Towards a Comprehensive Definition of Mixed legal Systems


Abstract :

Mixed legal systems occupy a prominent place in comparative legal studies. The importance of these systems is due to the fact that they are a blend of different legal cultures and ensure the management of various ingredients.
Despite the specificity and prevalence of this family within contemporary legal systems, it is nearly impossible to find a satisfactory definition. Comparative jurisprudence in this regard attests several trends, including narrow and broader concepts. This contribution aims to review the most important opinions in this regard and then apply them to the legal system of the province of Quebec in Canada as the heir to the French and English legal traditions and to the Iraqi legal system where Islamic law interact with Western Legal models.
